Procedure:
In accordance with section 13 of the Industrial Relations Act 1969 (as amended), this dispute was assigned to me for investigation by the Director General. A hearing was arranged for Friday, July 25th 2025 at 9.30am. Mr Michael McGrath of IBEC attended to represent the employer. The worker did not attend and did not contact the WRC to explain the reason for his non-attendance.
The documents on the case file include a copy of a letter dated June 26th 2025 which was sent to the worker by email to the email address he provided on his complaint form. The purpose of the letter was to notify the worker of the date and time of the hearing on July 25th. I am satisfied therefore, that the worker had four weeks’ notice of the hearing and, in the absence of any explanation for not attending, I have reached the conclusion below.
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances in which the worker did not attend the hearing, I recommend that the parties take no further action regarding the matter in dispute. |
