Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant, a Customer Service Advisor, refer his compliant relating to annual leave under the Payment of Wages Act 1991 to the Workplace Relations Commission on 24 April 2025. Documentary evidence was furnished by the Complainant in advance of the hearing. The Respondent attended at hearing and relied upon written submissions. |
Summary of Complainant’s Case:
After waiting a reasonable period, the Complainant failed to attend at the hearing. Having review the file, I am satisfied that he was on notice of hearing with a phone call being made to him by the Workplace Relations Commission in the days prior to the hearing. The Complainant was spoken to directly. |
Summary of Respondent’s Case:
The Respondent denied the complainant and provided documentary evidence to support its position. |
Findings and Conclusions:
The Complainant failed to attend at the hearing with the Respondent attending submissions and documentary evidence to rebut the complaint. I am dismissing the claim for the Complainant’s failure to attend. For this reason, I find the complaint is not well founded.

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
