Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 – 2015 following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
The Complainant brought a complaint under the Employment Equality Act; however, on the face of the complaint it related an incident of alleged bullying. Again, at face value it would appear that the complaint was investigated. The employee has left her employment and returned to Spain and while her preference was for a remote hearing the case was set down for a face-to-face hearing having regard to the gravity of the matters raised. |

Findings and Conclusions:
The Complainant consented to email communication and was notified of the date, time and place of the hearing at the email provided. I am satisfied that she was properly notified of the hearing. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
As the Complainant failed to attend at the hearing and the Employer did attend and was ready to rebut the allegations made against them, I dismiss the claim for failing to attend and determine that the Complainant was not discriminated against on the ground of race, was not victimised and was not discriminated against relating to her terms and conditions of employment on the ground of race. |
