Procedure:
A complaint was received by the Director General of the Workplace Relations Commission on 17 January 2025 from Ms. Fernanda Shiromaalleging that the Respondent, Rosada Developments Ltd, contravened the provisions of Section 8 of the Unfair Dismissals Act, 1977. The said complaint was referred to me for investigation.
A hearing for that purpose was convened on 29 July 2025.
There was no appearance by or on behalf of the complainant at the hearing.
Mr. Michael O’Sullivan, Counsel was present to represent the Respondent, and was instructed by Ms. Bronagh Savey and Ms. Amy O’Rourke, Shannon & O’Connor Solicitors. Ms. Maria Seidner, Operations Manager and Ms. Juliana Mendin, HR attended on behalf of the Respondent.
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
The Respondent was in attendance, was available to give evidence and had provided a written submission in advance of the hearing.
The Complainant did not attend the hearing and I was satisfied that notice containing the details of the date, time and place of the hearing had been properly communicated to the Complainant.
As no further communication was received at the time of finalising this decision and in the context that I am satisfied that the said complainant was informed in writing of the arrangements for the hearing and in the absence of any explanation for her non-attendance, I must conclude that the within complaint is not well-founded and I decide accordingly.
