Workplace Relations Commission Adjudication Officer: Brian Dalton
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
In her complaint form the Complainant stated the following: “Under the direction of Mr. Bassey Duke on the following dates: July 3, 4, 7, 8, 11, 12, 13, 14, 16, and 18, 2024, for a total of 10 days worked. As agreed, I was supposed to receive a payment of €128.25 per day worked. However, to date, I have only received partial payments: €28.25 on July 19 and €128.25 on July 20, totaling €156.50. I am still owed €1,126 for the days worked.”
The Complainant failed to attend at the hearing. |
Summary of Complainant’s Case:
The Complainant was notified of the time, place and date of the hearing and failed to attend. |
Summary of Respondent’s Case:
The Respondent failed to attend and was notified of the time, date and place of the hearing at the registered address for the business. |
Findings and Conclusions:
The Complainant consented to email communication and failed to attend at the hearing. In these circumstances I must dismiss the claim for failure to attend. I determine that the complaint is not well founded. |
