Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant stated on his complaint form that he applied for a position with the Group and moved from England to take up the role only to find that the role promised was not immediately available. It is alleged that the Complainant worked in other practices within the group and based on low fee income wages due were withheld. Arising from that failure to honour his contract term, a payment owing was never paid. This created significant pressure on him and his family. The matter first was listed during 2024 and postponements were granted and finally the matter was listed for a remote hearing. |

Findings and Conclusions:
The Complainant failed to attend at the hearing and to make out his case. I am satisfied that the was properly notified of the date, time and fact of a remote hearing. The Respondent failed to attend. In these circumstances I must dismiss the complaint for failing to attend and determine that the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complainant failed to attend at the hearing and to make out his case. I am satisfied that he was properly notified of the date, time and fact of a remote hearing. The Respondent failed to attend. In these circumstances I must dismiss the complaint for failing to attend and determine that the complaint is not well founded. |
