Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant alleged that he was unlawfully deducted €540 arising from the following alleged facts:
I attended the training on November 14, 2024. Due to their problems, I did not complete the training that should have been completed in one day, so I spent an extra two days to complete the training, and then I participated in the work. After I worked for one day, I was told the next day that I was fired because I did not have stamp 4. Before I joined the company, I clearly told them that I only had stamp 1G, but they did not care. Before leaving, they clearly said that they would pay me for working one day and participating in the training, but when the time came, they did not pay and did not respond to any of my calls and messages
He failed to attend at the hearing.
The Company attended and was ready to rebut the allegation.

Findings and Conclusions:
The Complainant was notified of the hearing by email and had consented to being communicated with by email. In these circumstances I must conclude that the Complainant was notified of the remote hearing, time and date of the hearing. As the Complainant failed to attend his claim must be dismissed for failure to attend. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complainant failed to attend, and I find that the complaint is not well founded. |
