Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
On 2nd August 2024, the Worker referred the present dispute to the Commission. Following the Employer’s failure to object to the same within the statutory timeframe, the matter proceeded to hearing. Said hearing was convened for, and finalised on, 18th March 2025. The hearing was held in person at Mullingar Courthouse, Co. Westmeath. Neither party issued any form of submission or correspondence in advance of the hearing. There was no appearance by or on behalf of either party at the hearing as listed. |
Summary of Worker’s Case:
As set out above, there was no appearance by the Worker at the hearing as scheduled. Having reviewed the file, it is apparent that the Worker was informed of the date, time and venue of the hearing in the normal course. In the days following the hearing, the Worker issued correspondence to the Commission, advising that she had received the notification but had missed the hearing due to inadvertence. Given that no exceptional circumstances were presented that might permit the hearing to be relisted, the matter is deemed to have proceeded in the Worker’s absence. |
Summary of Employer’s Case:
As set out above, the Employer did not attend the hearing as scheduled. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
As neither the Worker nor the Employer attended the hearing, I make no recommendation in relation to the dispute as referred.
