Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.

The Respondent was represented at the hearing.
No submissions were received by either party. |
Summary of Complainant’s Case:
After waiting a reasonable period of time, there was no appearance by or on behalf of the Complainant. Every effort was made to contact the Complainant through his solicitor who subsequently advised that the Complainant be contacted directly. This was done. Having reviewed the file I am satisfied the Complainant was on notice of the hearing date. |
Summary of Respondent’s Case:
It was submitted that the Respondent did not accept the complaints made by the Complainant. It is a large company with a large multinational workforce and takes it’s employment obligations very seriously. An application was made to anonymise the Respondent’s name in the circumstances there were 12 serious complaints initiated against it which it rejected in their entirety. |
Findings and Conclusions:
On the basis the Complainant did not present to give evidence in his own complaints, I find each of the complaints are not well founded and in the instance of complaints of discrimination, I find that he was not discriminated against by the Respondent. In terms of the anonymisation, where there were very serious allegations levelled at the Respondent and in the absence of the complaints being heard, it is appropriate not to publish the parties names. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I find each of the complaints are not well founded. In the instance of complaints of discrimination, I find that he was not discriminated against by the Respondent. |
