Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Respondent attended the hearing and conceded the claim. Mr. Ainscough stated that he employed about 16 staff and had experienced a high level of staff turnover and that was one of the reasons why he hadn’t provided the necessary information to the Complainant.
The Complainant started his employment on the 10th of July 2024 and left on the 30th of October 2024.
His gross weekly wage is €721.50. |

Findings and Conclusions:
The Act provides for up to 4 weeks compensation for failing to provide the required information as detailed in the Act. Having regard to the relative short period of service and the fact that this business is relatively small a proportionate and fair amount is 2 weeks compensation. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Act provides for up to 4 weeks compensation for failing to provide the required information as detailed in the Act. Having regard to the relative short period of service and the fact that this business is relatively small a proportionate and fair amount is 2 weeks compensation. I order the Respondent to pay the Complainant €1443 (fourteen hundred and forty-three euro). |
