Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant worked for the Respondent is a logistics company from the 19th of October 2021 until the 10th of March 2022.
The Complainant submitted a complaint alleging that she did not receive her Terms and Conditions of Employment.
A hearing was held into the matter on the 13th of September 2023. The Complainant did not attend.
The Respondent attended the hearing represented by Ellen Walsh of Peninsula. |
Summary of Complainant’s Case:
The Complainant failed to attend the hearing. |
Summary of Respondent’s Case:
The Respondent attended and made written submissions in advance of the hearing. |
Findings and Conclusions:
On review of the correspondence on file I am satisfied that the Complainant was notified of the hearing date and time. She failed to attend the hearing and pursue her case. In the circumstances I am satisfied that the complaint should fail. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is not well founded. |
