Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
| The Complainant’s case is for unpaid wages. 
 The Respondent has ceased trading. A liquidator had not been appointed to wind up the Respondent.

Summary of Complainant’s Case:
| He did not receive his wages for the last weeks of employment. 
 This amounts to €5,700.00. | 
Summary of Respondent’s Case:
| The owner of the Respondent attended the hearing. He confirmed that the Complainant was due €5,700.00 in outstanding wages. 
 He explained how the Respondent did not have the resources to pay the outstanding wages. | 
Findings and Conclusions:
| The facts of the complaint were not in dispute. | 
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
| The case is well founded. I award the Complainant the sum of €5,700.00. This is a gross payment. |
