Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant handed in his notice on the 30th May, 2019. The Monday was a bank holiday. The complainant did not receive any pay for the four days. He is entitled to €440.00 ( €110 per day) plus €110 his bank holiday pay. |
Summary of Respondent’s Case:
The complainant called in sick on the 29th May, 2019. He also stated that he was resigning with immediate effect. Then he came in on the Friday and said that he did not want to work out his notice but would take his holidays instead. The Respondent accepts that the complainant is owed for four days. Money was deducted from the complainant’s wages in relation to damage caused to a company car. The respondent accepts that that should have been capped and that complainant is owed € 365.90. |
Findings and Conclusions:
The respondent accepts that the complainant is owed four days wages and the bank holiday pay together with € 365.90 in relation to the deduction made for damage to the vehicle. On that basis, I find that the complainant is well founded. I award the complainant € 915.90. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
