Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
The matter was due to be heard on Tuesday 26 March at 10.30 am. The worker did not attend the hearing. I established that the worker was on notice of the date and time of the hearing of the complaint. I waited for 20 minutes in the event that the worker had been delayed. There was no further contact from the worker. |
Summary of Complainant’s Case:
The worker did not attend the hearing and was not represented. |
Summary of Respondent’s Case:
The employer attended the hearing and was available to provide its evidence in relation to the dispute. |
Findings and Conclusions:
On the basis that the worker did not attend the hearing and in circumstances where I am satisfied that the said worker was informed in writing of the date, time and place at which the hearing would be held; I find that in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within dispute is not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the dispute in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
The worker did not attend the hearing to pursue his trade dispute. On that basis, I find that the within dispute is not well-founded. |
