Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant worked for the Respondent business from 11/05/2015 to 18/03/2019. He was employed as a technician earning €438.73 per week, as per complaint form he worked 34 hours per week. This complaint was received by the Workplace Relations Commission on 21st March 2019. |
Summary of Complainant’s Case:
The Complainant commenced employment as a technician and the employment was unremarkable until 2019. The Complainant informed the hearing that his employer simply disappeared and that he had not received any wages since early in February. In total the Complainant contends that he is now owed a total of €3,236.54. On 14th March the Complainant received a total of €360 paid in cash, he required this amount to pay his rent. The Respondent has simply disappeared. The Complainant contends that the Respondent has returned to India. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing of the complaint. Correspondence relating to the hearing i.e. date, time and venue were sent to the Respondent on 1st May 2019. |
Findings and Conclusions:
I accept the Complainant’s version of events and have decided that the complaint is well founded and therefore find in favour of the Complainant. I order the Respondent to pay the complainant outstanding wages of €3,236.54. Such payment should be made within 42 days from the date of this decision. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
