Complaint seeking adjudication by the Workplace Relations Commission under section 13 of the Industrial Relations Act, 1969 | CA-00026953-001 | 11/03/2019 |
Date of Adjudication Hearing: 04/06/2019
Workplace Relations Commission Adjudication Officer: Ewa Sobanska
Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
The Worker referred her claim to the WRC on 11th March 2019. At the time the adjudication hearing was scheduled to commence, it became apparent that there was no appearance by either party. I am satisfied that the parties were notified of the venue, date and time of the hearing. I waited some time to accommodate a late arrival. |
Summary of Worker’s Case:
There was no appearance by or on behalf of the Worker. |
Summary of Employer’s Case:
There was no appearance by or on behalf of the Employer. |
Findings and Conclusions:
Section 13 of the Industrial Relations Act, 1969, requires that I investigate any dispute before me and make a recommendation in relation to it. However, the joint absence of the parties at the hearing set for this purpose means that I am not in a position to investigate the matter. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
Given that I was unable to investigate the dispute for the reasons outlined above, I am equally unable to make a recommendation in respect of it. |
