Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant did not attend he hearing. While she telephoned to explain her inability to attend due to an episode of ill health on her way to the hearing. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. |
Findings and Conclusions:
As will be clear the decision in this case was considerably delayed in view of the complainant’s reason for failing to attend. However, nothing further was heard from her and accordingly her complaint for want of prosecution and I now dismiss the complaint. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons stated above I do not uphold complaint CA-00007723 and it is dismissed. |
