Procedure:
In accordance with Section 41 of the Workplace Relations Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The claimant submitted that the respondent failed to accommodate him in relation to his employment. The respondent submitted that the complaint by the claimant did not fall within the remit of the Terms of Employment(Information) Act 1994 .
Findings
The complaint before the Adjudicating Officer was under the Terms of Employment (Information) Act 1994
I find that having heard the evidence from the claimant his complaint falls outside the scope of Terms of Employment (Information) Act 1994
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find the complaint is not well founded and falls.
