Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
1: Summary of Complainant’s Case:
The Complainant did not attend the hearing and no evidence was presented. |
2: Summary of Respondent’s Case:
As there was no appearance by the Complainant the Respondent was not called upon to give any rebuttal evidence. It was pointed out that claim was an almost identical replica of an earlier claim disposed of in Adjudication 4613 |
3: Findings and Conclusions:
As the Complainant, did not attend, the case was dismissed for want of prosecution. The matters concerned had already been the subject of an earlier Adjudication decision. I was satisfied that the Complainant had been properly notified of the Hearing. |
4: Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
