Complaint seeking adjudication by the Workplace Relations Commission under Section 39 of the Redundancy Payments Act, 1967 | CA-00011039-001 | 28/04/2017 |
Date of Adjudication Hearing: 01/05/2018
Workplace Relations Commission Adjudication Officer: Gaye Cunningham
Procedure:
In accordance with Section 39 of the Redundancy Payments Act 1967,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant states that she was made redundant from her job in May 2016 and has been trying to get payment for her statutory entitlement since then from the employer, who promised on a number of occasions to give her the redundancy payment. She calculated the payment to be €3,000 based on 2 years and two months service and the statutory cap of €600 per week. The employer did not attend the hearing. |
Decision:
Based on the uncontested evidence of the Complainant I declare that she is entitled to a statutory redundancy payment of €3,000 and I require the Respondent to pay this amount to her within six weeks of the date of this decision. |
