Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015, these complaints were assigned to me by the Director General. A hearing was arranged for February 7th 2018 to give the parties an opportunity to be heard and to present evidence relevant to the complaints.
The complainant did not attend the WRC at the scheduled time of 9.30am, although the respondent was in attendance. I established that the complainant was correctly on notice of the hearing and waited for a few minutes after the scheduled start time. I then phoned the complainant on the number he provided on his complaint form. He said that he was delayed because his train had stopped to facilitate a sick passenger and that he would not make it to the WRC.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complainant did not attend the hearing scheduled for February 7th 2018. As he has failed to attend to establish the validity of his complaints, I conclude the investigation and find against the complainant. |
