Procedure:
In accordance with Section 41 of the Workplace Relations Act, and Section 6 of the Payment of Wages Act, 1991 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The case concerns a specialist Electrical Contracting Company. The Claimant was employed as a Graphic Designer from June 2016 to February 2017. At the conclusion of his employment he alleged that he was due outstanding Wages and Notice Pay. |
1: Summary of Complainant’s Case:
The sum of € 2,704.09 (as per a pay slip exhibited in evidence) is due to the Complainant. This comprises wages for the month of January 2017, outstanding Holidays and notice Pay. This was not disputed by the Respondent. |
2: Summary of Respondent’s Case:
The Respondent acknowledged that the amount cited was due to the Complainant and would be paid as soon as his finances allowed. |
3: Findings and Conclusions:
On the basis of the uncontested evidence I award, under Section 6 of the Payment of Wages Act, 1991, the sum of € 2,704.09 to the Complainant. The money to be paid no later that four weeks from the date of issue of this Adjudication Decision. The question of the Taxation of this award is a matter to be clarified by the parties with the Revenue Commissioners. |
4: Decision:
Section 41 of the Workplace Relations Act 2015 and Section 6 of the Payment of Wages Act, 1991 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions of the cited Acts.
