In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The Complainant was employed as a Security Officer since 1st September 2008. He was paid €1,100 per fortnight. He has claimed that his employer has not notified him in writing of changes to his terms and conditions of employment.
Summary of Complainant’s Case:
The Complainant did not attend and was not represented at the hearing.
Summary of Respondent’s Case:
The Respondent advised the hearing that they had spoken to the Complainant last week and he returned a business key to them. He advised them that he had left the employment and found other work and he was not pursuing this claim. They advised him to contact the Workplace Relations Commission and inform them of this decision.
Findings and Conclusions:
I note that the Complainant did not attend and was not represented at the hearing. I note correspondence on file advising both parties of the venue, date and time of this hearing. The Complainant did not present any complaint to the Commission on the day.
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act. I have decided that this complaint fails as no complaint was prosecuted on the day.
