Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and the abovementioned Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Complainant’s Submission and Presentation:
I handed in Form RP77 to my employer, with the box ticked that I had not received any redundancy payment. I was made redundant in February 2016 and have had no communication from my employer since then. I called into the Department of Social Protection to inquire about my redundancy payment, and they had no knowledge of my situation. |
The respondent employed the complainant as a barman in the period 22nd of July 2012 until the 28th of February 2016. He was paid €240 per week. The respondent was locked out of the premises and the complainant was left with no work on that date.
Decision:
Based on the uncontested evidence adduced at hearing I find that the complaint is well founded. I hereby require that the respondent pay the claimant his statutory entitlement to redundancy pay in accordance with the provisions of this enactment in the amount of €1,972.80.
