Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Complainant’s Submission and Presentation:
Company have failed to investigate my grievance. To date I have not been furnished with the outcome of an investigation. The company failed to provide a safe working environment. |
The Claimant is taking his claim under section 28 of the Safety, Health & Welfare at Work Act 2005.
Respondent’s Submission and Presentation;
The Respondent set out the history of the Claimant’s grievance and the detail of the investigation in line with SI 146/2000. The outcome of the investigation concluded that mediation between the parties involved in the incidents. The Claimant rejected this.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Decision:
I have considered the submissions made by the parties. In line with my decision, Adj 1820 between the same parties I find that the Respondent discharges their duties under section 28 of the Safety, Health & Welfare at work Act 2005.
I do not find the claim well founded and it fails.
