1. A complaint that the Decision of an Adjudication Officer no r-157880-wt-15/SR was not implemented.
2. The Worker referred her case to the Labour Court on the 18th July 2016, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Determination of the Court:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act 1997 (the Act), by Ms Caroline Danaher, 32 An Sruthan, Loughrea, Co. Galway, that her employer Sean Og Duffy, Glenbrack, Gort, Co. Galway, failed to implement a decision of an Adjudication Officer (formerly known as a Rights Commissioner) No. r-157880-wt-15/SR and dated 8thApril, 2016,
And the said decision not having been carried out by the employer,
And no appeals having been brought against the said decision with the time limit for such appeals,
The Court hereby determines that the said Respondent must pay the Complainant the sum of €1,100.00 in accordance with the decision of the Adjudication Officer.
