Appellant(s) : Mr. Richard Grogan, Richard Grogan & Associates, Solicitors
And Registered, Tax Consultants, 16-17 College Green, Dublin 2
Respondent(s) : In person
The decision of the Tribunal was as follows:
The appellant was employed by the respondent from March 2006 until her employment ended when the shop she worked in closed down in December 2014. The appellant’s representative stated that the appellant was entitled to a redundancy payment and four weeks’ notice payment of which one week was received. The respondent stated that he could not pay the redundancy sum due to the appellant.
On the uncontested evidence of the appellant, the Tribunal finds that the appellant is entitled to a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of birth:
Date of commencement: 31st March 2006
Date of termination: 23rd December 2014
Gross weekly pay: €362.70
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
The Tribunal also awards the appellant her statutory entitlement of €1,088.10 being the sum due for three weeks’ notice, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
