EMPLOYMENT APPEALS TRIBUNAL
CLAIM(S) OF: CASE NO.
Helen Byrne UD136/2014
TJC Happy Events Limited T/A Mr. Price Branded Bargains
UNFAIR DISMISSALS ACTS, 1977 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Mr. N. Russell
Members: Mr. J. Browne
Ms. S. Kelly
heard this claim at Wexford on 25th May 2015
and 28th July 2015
Claimant: Solicitor on behalf of the claimant (25th May 2015)
Not Present or Represented (28th July 2015)
Respondent: Collier Broderick, Management Consultants, Unit 17, St. Olaves Bus Centre,
Malahide Road, Co. Dublin
The determination of the Tribunal was as follows:-
On the first day of the hearing a named solicitor who then represented the claimant applied and was granted a postponement on the hearing on medical grounds in respect of the claimant.
On the second day of the hearing neither the claimant nor a representative on her behalf attended at the appointed time of 10.30am. The named solicitor who had represented the claimant had previously notified the secretariat of the Tribunal that he was coming off record as representative for the claimant.
Having waited a period of thirty minutes the hearing commenced at 11.00am.
The Tribunal are satisfied the claimant was properly notified of the date, time and location of the hearing on the 28th July 2015. Neither the claimant nor a representative on her behalf attended.
As this is the case the claim under the Unfair Dismissals Acts, 1977 to 2007 fails for want of prosecution.
