The decision of the Tribunal was as follows:
The respondent agreed to allow the amendment of the Work Relations Complaint form to show the correct name of the respondent as set out above. The Tribunal heard that as a result of an unfair dismissal the claimant did not receive her minimum notice of two weeks.
While the Tribunal noted that the Rights Commissioner, in his recommendation, referred to the fact that “on the balance of probabilities, that the claimant was guilty of misappropriating funds”, a decision that the claimant was unfairly dismissed was nevertheless issued. Accordingly, the claimant is entitled to receive her minimum notice of two weeks’ pay totalling €680. The Tribunal makes this award under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
