1. A complaint that a Rights Commissioner's Decision was not implemented no: r-143188-wt-14/JOC.
BACKGROUND:
2. The Worker referred his case to the Labour Court on the 22nd September 2015 in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Determination of the Court:
DETERMINATION:
A complaint having been made under Section 28(8) of the Organisation of Working Time Act 1997 by Eddie Power, ‘Braemont’, Sporthouse, Butlerstown, Co. Waterford, that his former employer, J.S.F. Construction Limited, Railway House, Cregg Road, Carrick-on-Suir, County Tipperary, failed to implement a decision of a Rights Commissioner, r-143188-wt-14JOC;
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal;
The Court hereby determines that the said employer pay to the said employee €1,027.96 in accordance with the decision of the Rights Commissioner.
