Determination
The Tribunal is satisfied that all parties were on notice of the hearing. There was no appearance by or on behalf of the respondent liquidator or receiver. The Tribunal heard the uncontested evidence of the appellant.
The appellant commenced employment in July 1995 and following a workplace accident in February 2008 was on certified sick leave when the respondent business closed in September 2013. Prior to the business closing the appellant had sought a return to work with light duties.
Based on the uncontested evidence of the appellant, the Tribunal awards him a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Commencement: 1 July 1995
Date of Termination: 30 September 2013
Gross weekly pay: €412.62
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period
