under

I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms P. McGrath B.L.
Members: Mr. J. O'Neill
Mr F. Keoghan
heard this appeal at Dublin on 19th March 2015
Representation:
Appellant: McDowell Purcell, Solicitors, The Capel Building, Mary's Abbey, Dublin 7
Respondent: E.M. O'Hanrahans Solicitors, 31 Fairview Strand, Fairview, Dublin 3
This appeal came before the Tribunal by way of an appeal by an employer against a Rights Commissioner Decision (reference: r-137997-pw-13/RG: r-131208-pw-13RG).
Determination:
Having considered the evidence of the claimant the Tribunal accepts that the claimant was financially disadvantaged by unilateral changes made to the calculation of working hours, including breaks, which the claimant had heretofore the benefit of.
The Tribunal therefore affirms the findings of the Rights Commissioner and awards the claimant the amount of €1326.00 under the Payment of Wages Act, 1991.
Sealed with the Seal of the
