The decision of the Tribunal was as follows:
This case came before the Tribunal by way of an employee appeal of a Rights Commissioner recommendation under the Payment of Wages Acts r-133626-pw-13/RG and Terms of Employment Act r-133622-te-13/RG.
This appeal was heard in conjunction with PW276/2014 and TE117/2014.
The claim under the Terms of Employment Information Act was withdrawn during the hearing.
The respondent submitted that as employees were transferred to Company S under the Transfer of Undertakings legislation on 1st June 2013, that the respondent had no liability in relation to appellent’s case. Company S, who also attended the hearing accepted liability and the Tribunal held that this respondent had no case to answer under the Payment of Wages Acts.
