BACKGROUND:
2. The Worker referred her case to the Labour Court in accordance with Section 28(8) of the Organisation of Working Time Act, 1997 on 16th October, 2015. The following is the Determination of the Court:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 by Jackie Kelly, 38 Woodstown Abbey, Woodstown Villiage, Knocklyon, Dublin 16 that her former employer Aztec Entertainment Limited T/A Base Entertainment Centre, Unit 12, Block C, M4 Interchange Park, Celbridge, Co Kildare failed to implement a decision of a Rights Commissioner, r-152999-wt-15/RG
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said Respondent must pay the Complainant the sum of €1,377.50 in accordance with the decision of the Rights Commissioner.
