APPEAL OF: CASE NO.
Roberto Suba PW327/13
against the decision of the Rights Commissioner in the case of:
Maybin Support Services Limited T/A Momentum Support
PAYMENT OF WAGES ACT, 1991
I certify that the Tribunal
(Division of Tribunal)
Chairman: Mr. C. Corcoran BL
Members: Mr F. Cunneen
Mr P Trehy
heard this appeal at Dublin on 15th September 2014.
Claimant: Migrant Rights Centre Ireland, 37, Dame Street, Dublin 2
Respondent: Bill Austin, IBEC, 84-86, Lower Baggot Street, Dublin 2
The decision of the Tribunal was as follows:
This case came before the Tribunal by way of an appeal by the appellant (the employee) against the decision of the Rights Commissioner under the Payment of Wages Act, 1991 (ref. r-128198-pw-12/MMG).
The appellant agreed that he did not notify the respondent of his intention to appeal the decision of the Rights Commissioner decision, ref. r-124014/pw-12/RG) as specified by section 7(2)(b) of the Payment of Wages Act, 1991. Consequently, the Tribunal does not have jurisdiction to hear the appeal and therefore the decision of the Rights Commissioner is upheld.
