I certify that the Tribunal

Members: Mr J. Horan

heard this claim at Dublin on 18th March 2014
Representation:

Respondent: Mr Tim O’Connell of IBEC,
Confederation House, 84/86 Lr Baggot Street, Dublin 2
The determination of the Tribunal is as follows:
These claims first came before the Tribunal on 3rd September 2013. The claims under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 and under the Organisation of Working Time Act, 1997 were withdrawn.
Determination
On 3rd September 2013 when this case first came before the Tribunal the matter was adjourned to give the claimant the opportunity to consider his position regarding the agreement he had entered into with the respondent at the termination of his employment.
The Tribunal is satisfied that the claimant was properly notified of the hearing scheduled for 18 March 2014 but he failed to attend or send a representative.
Accordingly the claim under the Unfair Dismissals Acts, 1977 to 2007 fails for want of prosecution.
