The determination of the Tribunal was as follows:-
Claimant’s Case:
The claimant commenced employment with the respondent firstly as a waitress then promoted to Supervisor and finally to Manager. She reported directly to the owner of the respondent company. There were no difficulties for the first five years of her employment. However matters changed in the final three years of her employment to the point that she felt she had no alternative but to leave her employment.
She told the Tribunal that her hours were cut; the owner undermined her position as Manager, ignored her on occasions and spoke to her in a rude manner. The claimant did make complaints concerning her treatment both verbally and in writing but the only person she could make these complaints to was the owner of the business. She left her employment on the 19th November 2011.
The claimant gave evidence of loss.
Determination:
The Tribunal is satisfied that the respondent was properly notified of this hearing. Neither they nor representatives on their behalf appeared for this case.
Based on the uncontested evidence the Tribunal finds that the claimant had no alternative but to leave her position of employment due to the treatment she had received from the owner of the respondent company.
Accordingly, the Tribunal awards the sum of € 15,000.00 under the Unfair Dismissals Acts, 1977 to 2007.
