The decision of the Tribunal was as follows:-
The respondent having conceded liability in regard to appellants numbered 1 and 2, the Tribunal finds that these appellants are entitled to lump sum payments under the Redundancy Payments Acts 1967 to 2007 based on the following criteria:
Appellant1. The claimants employment by reason of redundancy.
The appellant is entitled to a redundancy payment based on:
Service from: 04-March-2002 to 19-August-2011
Normal weekly remuneration:€600.00
Non-reckonable service: 19-August-2008 to 02-March 2009
01-August-2009 to 19-April-2010
04-August- 2010 to 17-January-2011
Amount of redundancy payment: €9912.00
Appellant 2. The claimants employment by reason of redundancy.
The appellant is entitled to a redundancy payment based on:
Service from: 06-June-2001 to 20-June-2011
Normal weekly remuneration:€600.00
Non-reckonable service: 06-June-2008 to 28-February 2009
14-November-2009 to 13-February-2010
14-September- 2010 to 31-January-2011
Amount of redundancy payment: €11064.00
A ceiling of €600.00 applies to any payments from the Social Insurance Fund and this award is subject to the claimant having been in employment which is insurable for all purposes under the Social Welfare Consolidation Act, 2005.
