The decision of the Tribunal was as follows:-
Determination
The appellant commenced employment in the respondent’s restaurant on 14 April 2007. On the 28 November 2012 she was due to commence work at 10.00a.m. When she arrived in work she was informed that the respondent was closing down. By 4p.m. the lights and electricity were switched off. She has had no contact from the respondent since that day. She did not sign an RP50 and she did not receive a redundancy payment or payment in lieu of notice.
On the uncontested evidence of the appellant the Tribunal awards her a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007 based on the following criteria:
Date of birth
Date employment commenced 14 April 2007
Date employment ceased 28 November 2012
Gross weekly pay €550.00
The appellant is entitled to compensation in the amount of €2,200.00 which is equivalent to four weeks gross pay (€550.00) under the Minimum Notice and Terms of Employment Acts
1973 to 2005.
