1. Appealing against a Rights Commissioner's Decision r-136750-wt-13/GC.
BACKGROUND:
2. The Worker appealed the Rights Commissioner's Decision to the Labour Court on 20th December 2013. A Labour Court Hearing took place on 30th April, 2014. The following is the Labour Court's Determination:-
DETERMINATION:
This is an appeal by Mr Cathal Donnellan (the Complainant) under the Organisation of Working Time Act 1997 (the Act), against Rights Commissioner's Decision No r-136750-wt-13/GC issued on 5th December 2013. The Rights Commissioner decided that the complaint was not well-founded.
An appeal was filed by the Complainant with the Court on 20th December 2013.
The case came on for hearing on 30th April 2014.
When the case was called there was no appearance by the Complainant. The appeal was not moved and no evidence was presented to the Court.
Determination
In the absence of any evidence to the contrary, the Court determines that the complaint is not well-founded.
The Decision of the Rights Commissioner is affirmed.
The Court so determines.
