The determination of the Tribunal was as follows:-
The claims under the Unfair Dismissals Acts, 1977 to 2007, and the Minimum Notice and Terms of Employment Acts, 1973 to 2005, were withdrawn at the outset.
The Tribunal, being satisfied that the respondent was properly on notice of the hearing, finds, based on the uncontroverted evidence of the appellants, that they were dismissed by reason of redundancy and, accordingly, are entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007 based on the following criteria.
Appellant No 1
Date of commencement of employment: 1st November 1999
Date of termination of employment: 30th July 2012
Gross weekly pay: €442.75
Appellant No 2
Date of commencement of employment: 16th February 2005
Date of termination of employment: 31st July 2012
Gross weekly pay: €185.98
These awards are made subject to the appellants having been in insurable employment under the Social Welfare Acts during the relevant period.
