Determination
It was conceded by the respondent that a redundancy situation existed in relation to the termination of the appellant’s employment. Accordingly, the Tribunal awards the appellant a lump sum payment under the Redundancy Payments Acts, 1967 to 2007 based on the following criteria:
Date of commencement: 23rd September 2001
Date of termination: 9th December 2011
Gross weekly pay: €350
This award is made subject to the appellant having been in employment which is insurable for all purposes under the relevant Social Welfare Acts.
The respondent consented to the amending of the T1A form to include a claim for minimum notice. Accordingly, the Tribunal finds that the appellant is entitled to €2,100 (being the equivalent of six weeks’ gross pay) under those Acts.
