EMPLOYMENT APPEALS TRIBUNAL
APPEAL OF: CASE NO.
Employee - appellant PW253/2012
against the recommendation of the Rights Commissioner in the case of:
PAYMENT OF WAGES ACT, 1991
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms S. Behan
Members: Mr D. Hegarty
Mr D. McEvoy
heard this appeal at Cork on 7th November 2013
Appellant: Ms Emer Murphy, Eamon Murray & Co., Solicitors,
6/7 Sheares Street, Cork
Respondent: No appearance or representation on behalf of the respondents
Neither the appellant nor the respondent appeared for this hearing; the Tribunal are satisfied that both were on notice of this hearing. At the commencement of the hearing the appellant’s representative made an application to have this case postponed which was refused by the Tribunal.
This case came before the Tribunal by way of an employee appeal of the Rights Commissioners Decision ref: r-116257-pw-11 JOC. As the claimant did not attend the Rights Commissioner hearing she is appealing the decision that the claim ‘falls for want of prosecution.’
As the appellant again failed to attend the hearing, the Tribunal dismisses the appeal of the Rights Commissioners Decision ref: r-116257-pw-11 JOC therefore upholding the Rights Commissioner’s Decision.
