The decision of the Tribunal was as follows:-
Determination
The Tribunal is satisfied that all parties were properly notified of the hearing. There was no appearance by or on behalf of the respondent. Based on the uncontested evidence of the claimants the Tribunal finds that the employment of each and every one of the claimants herein was terminated without giving them their due entitlements under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
Claimant 1 The claimant’s employment which commenced with the respondent on 24 April 2006 was terminated by the respondent on 25 August 2011. The Tribunal awards claimant 1 €1,720.00, being the equivalent of four weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
Claimant 2 The claimant’s employment which commenced with the respondent on 6 October 1980 was terminated by the respondent on 25 August 2011. The Tribunal awards claimant 2 €3,006.08, being the equivalent of eight weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
Claimant 3 The claimant’s employment which commenced with the respondent on 10 January 1989 was terminated by the respondent on 25 August 2011. At the time of the termination of his employment he had an outstanding entitlement of two weeks holiday pay. The Tribunal awards claimant 3 €6,338.80, being the equivalent of eight weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005. The Tribunal further awards the claimant €1,584.70, being the equivalent of two weeks’ gross pay, in lieu of holiday pay under the Organisation of Working Time Act, 1997.
Claimant 4 The claimant’s employment which commenced with the respondent on 18 August 1975 was terminated by the respondent on 25 August 2011. At the time of the termination of his employment he had an outstanding entitlement of two weeks holiday pay. The Tribunal awards claimant 4 €6,338.80, being the equivalent of eight weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005. The Tribunal further awards the claimant €1584.70, being the equivalent of two weeks’ gross pay, in lieu of holiday pay under the Organisation of Working Time Act, 1997.
Claimant 5 The claimant’s employment which commenced with the respondent on 22 November 2000 was terminated by the respondent on 25 August 2011. The Tribunal awards claimant 5 €2,754.66, being the equivalent of six weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
Claimant 6 The claimant’s employment which commenced with the respondent on27 July 1987 was terminated by the respondent on 25 August 2011. The Tribunal awards claimant 6 €3878.40, being the equivalent of eight weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
Claimant 7 The claimant’s employment which commenced with the respondent on 5 October 1976 was terminated by the respondent on 25 August 2011. The Tribunal awards claimant 7 €4,585.04, being the equivalent of eight weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
Claimant 8 The claimant’s employment which commenced with the respondent on 1 September 1975 was terminated by the respondent on 25 August 2011. The Tribunal awards claimant 8 €4,329.28, being the equivalent of eight weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
Claimant 9 The claimant’s employment which commenced with the respondent on 15 August 2006 was terminated by the respondent on 25 August 2011. The Tribunal awards claimant 9 €1,492.00, being the equivalent of four weeks’ gross pay, in lieu of notice under the Minimum Notice and Terms of Employment Acts 1973 to 2005.
