1. Complaint That The Decision Of A Rights Commissioner Has Not Been Complied With R-073119-Mw-08
BACKGROUND:
2. The worker referred his case to the Court on the 19th June, 2009, in accordance with Section 31(1) of the Minimum Wage Act, 2000. The following is the Court's determination:
DETERMINATION:
A complaint having been received under the National Minimum Wage Act, 2000, by Mr. Robert Swaczyna, 26 Cluain Ard, Ballybrit, Galway, Co. Galway that his former employer, William McDonagh, t/a Connaught Landscape, 14 Sceilg Ard, Headford Road, Galway, Co Galway failed to implement a decision of a Rights Commissioner R-073119-mw-08/GC, dated 7th April, 2009
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said complainant €1,351.50 in settlement of his claim under the National Minimum Wage Act, 2000, in relation to the underpayment of wages.
