1. Complaint that a Rights Commissioner’s Decision has not been implemented WT57599/07/MR.
BACKGROUND:
2. A Labour Court hearing took place on the 2nd September, 2009. The following is the Determination of the Court:-
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working time Act, 1997 by Milan Malchárek, c/o Eimear Griffin, Murphy Ramsay Walsh Solicitors, 12 Ashe Street, Tralee, Co. Kerry, that his former employer, Bryan Hanson, Ballydwyer West, Ballymacelligott, Tralee, Co. Kerry, failed to implement a decision of a Rights Commissioner WT57599/07/MR
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €4,000, less €3,000 already paid, in accordance with the decision of the Rights Commissioner.
