INDUSTRIAL RELATIONS ACTS, 1946 TO 1990 SECTION 83, EMPLOYMENT EQUALITY ACT, 1998 PARTIES : EAGLE STAR LIFE (REPRESENTED BY IRISH BUSINESS AND EMPLOYERS CONFEDERATION)) - AND - MARK SAVAGE DIVISION : Chairman: Ms Jenkinson Employer Member: Mr Murphy Worker Member: Mr Nash |
1. Appeal under Section 83 of The Employment Equality Act, 1998, DEC-E/2007/051.
BACKGROUND:
2. A Labour Court hearing took place on the 22nd April, 2008, in accordance with Section 83 of the Employment Equality Act, 1998. The following is the Court's Determination:-
DETERMINATION:
This is an appeal by Mr. Mark Savage of an Equality Officer’s Decision dated 14th September 2007. As Mr. Savage did not attend the Equality Tribunal’s hearing the Equality Officer found that he had failed to establish aprima faciecase of discrimination and therefore his complaint failed.
Mr. Savage failed to attend the hearing set up by the Labour Court for 22nd April 2008, to hear his appeal and despite its efforts, no contact could be made with him. Therefore, the Court finds that Mr. Savage’s appeal fails for lack of prosecution and the Equality Officer’s Decision stands.
The Court so determines.
Signed on behalf of the Labour Court
