INDUSTRIAL RELATIONS ACTS, 1946 TO 2004
SECTION 13(9), INDUSTRIAL RELATIONS ACT, 1969
HEALTH SERVICE EXECUTIVE
- AND -
(REPRESENTED BY AMALGAMATED TRANSPORT AND GENERAL WORKERS' UNION)
Chairman: Mr Duffy
Employer Member: Mr Murphy
Worker Member: Mr O'Neill
1. Appeal of Rights Commissioners Recommendation R-033644-Ir-05-DI.
2. The following is the Court's Decision:
The Claimant in this case is retired and is not a worker within the meaning of the Industrial Relations Acts, 1946 to 2004. Accordingly, the Court cannot entertain this appeal, as it has no jurisdiction to investigate a dispute between the Claimant and his former employer.
The Court has reached this conclusion with regret. It would again urge the appropriate authorities to consider providing appropriate arrangements through which persons who have retired can pursue grievances concerning their occupational pensions.
