SECTION 28(8), ORGANISATION OF WORKING TIME ACT, 1997

1. Alleged non-implementation of Rights Commissioner's Decision WT4181/01/CW.
2. A Labour Court hearing took place on the 6th of September, 2001. The following is the Court's determination:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 (The Act) by Ms Stanislava Dalton, 58B Palmerston Road, Rathmines, Dublin 6, that her former employer Vanbera Limited trading as Conlon Catering, the United Arts Club, 3 Upper Fitzwilliam Street, Dublin 2, failed to implement a decision of a Rights Commissioner WT4181/01/CW dated 15th May, 2001,
and the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time allowed for such an appeal,
The Court hereby determines that the said employer pay to the said employee the sum of £500 (634.87 Euro) in respect of holiday pay in accordance with the decision of the Rights Commissioner.
The Court so determines.
