SUBJECT:

1. Appeal Of Adjudication Officer Decision No. ADJ-00013264 CA-0001724-001, 003

BACKGROUND:

2. The Worker appealed the Decision of the Adjudication Officer to the Labour Court on 20 May 2020 in accordance with section 28(1) of the Organisation of Working Time Act, 1997. A Labour Court hearing took place on 1 March 2022. The following is the Determination of the Court:

DETERMINATION :

Background

Mr. Scullion, ‘the Complainant’, appealed a Decision of an Adjudication Officer. The Decision was that his claim under the Organisation of Working Time Act, 1997 against Boots Retail Ireland Limited, ‘the Respondent’, was well founded and that compensation of €1000 should be paid.

Some preliminary points were raised in submissions by the parties.

The Court invited both parties to a hearing to consider these preliminary matters.

The Complainant failed to appear to present his appeal. Accordingly, there is no appeal for the Court to consider.

Determination

The Decision of the Adjudication Officer is affirmed.

Signed on behalf of the Labour Court

Tom Geraghty
